Measure 37, as provided under ORS chapter 197 , states that the owner of private real property is entitled to receive just compensation when a land use regulation is enacted after the owner or a family member became the owner of the property if the regulation restricts the use of the property and reduces its fair market value. In lieu of compensation, the measure also provides that the government responsible for the regulation may choose to “remove, modify or not apply” the regulation.
In November 2007, Oregon voters approved Measure 49, which modified Measure 37. The Oregon Department of Land Conservation and Development is authorized under Measure 49 to evaluate existing Measure 37 claims. Measure 37 claims are those claims submitted to the state on or before June 28, 2007. Claims received after June 28, 2007 will be treated as new Measure 49 claims and must be based on land use regulations adopted after January 1, 2007.
